La Creole Sewer Resolution

Why Moderate Signal: No vote is happening yet, but the Council will discuss a resolution that would allow the city to use eminent domain if necessary.

The La Creole Node is designed to bring new commercial, mixed-use, and residential land to the City of Dallas. The completion of the sewer line project is one of the things needed to prepare for future development.

Phase A of the sewer project was completed in 2025 along E Ellendale Avenue and SE Hawthorne Avenue. Phase B is currently in design, and the line is expected to run through private properties. The proposed sewer line will likely end up under the planned public streets.

To complete Phase B, the city needs to get easements for the sewer line from current property owners. A meeting was already held with affected owners, and there were some additional one-on-one conversations. According to the staff report, owners who attended the meeting and spoke to the city understood the need for the easements and that the city would purchase them.

The next step would be for the City Manager to make fair market offers to the property owners for the easements. The city anticipates that will be a smooth process.

Under the proposed resolution, if a property owner doesn’t accept a fair market offer for the easement, the city could use the legal process of condemnation (also known as eminent domain) to obtain the easement.

  • What would the resolution do?
    • Authorize the City Manager to negotiate just compensation for the easements with each property owner
    • If no agreement is reached, the City Manager could start condemnation (eminent domain) proceedings

The City Council is reviewing this proposed resolution early because of the sensitivity of the topic. This is a time for the Council to ask questions and discuss. A vote on this resolution is scheduled for October 19th.
