Dallas Mill Site Area Redevelopment Plan

A joint Council work session with the Dallas Planning Commission will review the Dallas Mill Site Area Redevelopment Plan.

The goal for the project is to: “Provide formal guidance for local land use and transportation improvements on and around the 66-acre former mill site…” – pg. 6 of the work session packet.

  • The City hopes for the following outcomes:
    • “Enhance the City’s tax base by providing opportunities for additional commercial and industrial development
    • Create economic development opportunities (jobs and investment)
    • Improve traffic flow through and around the area
    • Fulfill missions of the South Dallas Urban Renewal District to eliminate area blight”

On Monday, David Evans & Associates (the consultant team on the project) will present an update of the plan to the Council & Planning Commission.

City Manager report

ADA ramps on SE Ash St.

The Dallas School District has asked for small changes to the agreement that was previously approved by the Council. This work relates to ramps and ADA improvements to the roads around the High School.

  • What are the changes the School District is asking for?
    • “The City will be solely responsible for selecting the lowest responsible bidder contractor(s) for the Project.”
    • “The City shall ensure that the District is indemnified and insured (as an additional insured under any insurance policies of the Contractor) by the Project contractor as an owner to the extent of any work on District property”
    • The City shall ensure that all employees of its selected Contractor pass adequate background checks that comply with the District contracting requirements.
    • “Each Party (the “Indemnifying Party”) hereby agrees to indemnify, hold harmless and defend the other Party, its directors, officers, employees, affiliates, and agents (each an “Indemnified Party”) against any and all liabilities, suits, judgments, settlements, obligations, fines, damages, penalties, claims, costs, charges and expenses, including, without limitation, all reasonable legal fees, expert fees and disbursements, which may be imposed upon or incurred by or asserted against any Indemnified Party by reason of or resulting from any accident, injury (including death) or damage to any person or property occurring as a result of the act or neglect of any employee of the Indemnifying Party engaged in the performance of the Project”

What will happen? If the Council votes to approve the District’s changes, then the ramp and sidewalk project will progress. Construction is expected to begin after school gets out for summer and be completed by August 30, 2025.

City Attorney Agreement

Lane Shetterly, the current City Attorney is retiring, and the current agreement ends March 28, 2025. The City has a new agreement with Sherman, Sherman, Johnnie & Hoyt, LLP to have 2 primary City Attorneys: Justin Thorp & Greg Goebel.

Will this increase the cost to the city? The monthly rate previously agreed to will stay the same. So, no increased cost to the city.

What will happen? The Council can vote to approve the agreement, or not.

RESOLUTIONS

No. 3543 – Adopting and appropriating a supplemental budget

Finance Director, Cecilia Ward will present a supplemental budget to the Council. This type of budget is needed when there are unexpected changes to the budget that are under 10%.

What will happen? The Council will vote to adopt the supplemental budget, or not.

No. 3544 – Authorizing the transfer of budgetary funds

Finance Director Ward will also present a budget transfer of funds from 1 category to another. The transfer will go towards a new backhoe for the Parks Department.

    • Increasing Parks Department – Equipment
      • $0 to $20,000

What will happen? The Council will vote to adopt the transfer of funds, or not.

No. 3545 – Grant for the construction of 10 new pickleball courts

Last year, the Council approved building 10 new pickleball courts in Dallas City Park at Levens St. and Brandvold Ave. Part of that plan was to secure an Oregon Parks and Recreation Department Local Government Grant to cover costs. After not getting the grant, the city planned to move forward anyways and use the Parks SDC (System Development Charges) fund to pay for it.

Why did the city not get the grant? Unsure. The City thinks it was because they had 2 projects on-going that were funded under the same grant (the Japanese Garden pedestrian bridge and restoration of the Japanese Garden).

The City had to abandoned ideas to pay for the courts from the Parks SDC fund for 2 reasons. First, requirements for floodplains were changed by FEMA (Federal Emergency Management Agency), which meant big mitigations would be needed.

Secondly, the location for the courts is where the old swimming pool was… well, is. The swimming pool in Dallas City Park is still there, underground.

What do you mean the pool is still there? “It had simply been filled in with loose, unsteady debris creating an unstable foundation for the
new courts. The old pool needs to be completely excavated and filled with stable material. The updated estimated total project cost is approximately $1.75 million.” – Staff Report, pg. 50 of the council agenda.

All these issues increased the projected cost for construction of the courts. The Park SDC fund can no longer cover the project alone.

However, now that the 2 projects previously funded under the grant are completed, the Council will consider whether to re-apply for the grant to help cover the additional costs.

  • Where is the money coming from?
    • $10,000 – Dallas Pickleball Club donation
    • $1,061,085.60 – grant request
    • $697,390.40 – Parks SDC fund

    • $1,768,476.00 – total estimate for the project

What will happen? The Council will vote to approve the resolution to re-apply for the grant, or not.
